Earflo, INC, together with its parents, subsidiaries and affiliates (the “Company”, “we”, “us” or “our”), is committed to protecting your (“your”, “your” or “user”) privacy and empowering you with this privacy policy (this “Privacy Policy”). This Privacy Policy explains how we collect, use, disclose, and apply the information collected when you access or use, or purchase any products through, our website located at https://www.earflocare.com (the “Site”), our mobile application, and our related products and services (collectively, the “Services”). Our Terms of Use, located on our Site (the “Terms”) are expressly incorporated herein, by, reference, and are an integral part hereof. All capitalized terms used but not defined herein shall have the meanings set forth in the Terms.
This Privacy Policy sets forth our policy with respect to information that we collect from you, on or through the Services, that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you (“Personal Data”, or “Personal Information”). We take the privacy of your Personal Data seriously. Because of that, we have created and abide by this Privacy Policy. By using the Services or interacting with us, you are agreeing to the application of this Privacy Policy. Please read the following carefully to understand how we collect, use, disclose, and maintain information that can be used to identify you. In addition, this Privacy Policy describes your choices for use, access, and correction of your Personal Data. If you do not agree to be bound by this Privacy Policy, please stop accessing or using the Services.
1. Changes to this Privacy Policy
We may change this Privacy Policy from time to time. In the event that we make changes to this Privacy Policy, we will notify you by revising the “Last Updated” date at the top of this Privacy Policy. If there are significant changes to this Privacy Policy, we will attempt to notify you directly by email or provide information via our home page prior to any such changes becoming effective. We encourage you to review our Privacy Policy whenever you use the Services to stay informed of the ways you can protect your privacy.
2. Information We Collect and Receive
2.1 Information You Provided to Us. We collect Personal Data that you decide to share with us. At times, we may require you to provide certain information in order to use certain parts of our Services, fulfill your requests, or provide you with certain services. When you use our mobile application, we may collect limited usage data, device information, and interaction data necessary to operate, maintain, and improve the app. The app is optional and does not provide medical advice or store health records. The Earflo device itself does not transmit personal information to us.
2.1.1 Purchasing Our Products. When you place an order using our Site, we collect some or all of the following information that you provide: name, billing address, shipping address, email address, telephone number, and payment information. We use a third-party payment processor to process payments made to us. We do not retain any of your payment information. All payment information is provided directly to our third party processors, either Shopify or PayPal, whose use of your Personal Data is governed by their privacy policy, which may be viewed at https://www.shopify.com/legal/privacy and https://www.paypal.com/us/webapps/mpp/ua/privacy-full.
2.1.2 Surveys. We may contact you to participate in surveys. If you decide to participate, you may be asked to provide certain information which may include Personal Data.
2.1.3 Communicating with Us. We collect Personal Data from you such as email address, phone number, or mailing address when you request information about our Services, register for our newsletter, request customer or technical support, apply for a job or otherwise communicate with us.
2.1.4 Social Media. We may offer forums, blogs, or social media pages, including for you to review your purchases of our products. Any content you provide on these channels will be considered “public” and is not subject to privacy protections.
2.1.5 Registration for Sweepstakes or Contests. We may run sweepstakes and contests. The information you provide may be used to reach you about the sweepstakes or contest and for other promotional, marketing and business purposes, if permitted by law.
2.2 Information We Obtain from Others. We may obtain Personal Data about you from third parties who help us provide our Services. We may also obtain some information from our marketing partners in order to inform you about products or services that we think you might be interested in. Finally, we may obtain information that does not identify you directly, but which is later used in a way that may directly identify you. We may combine that general information with your Personal Data to provide related services to you.
2.3 Information We Automatically Collect. We automatically collect certain information from you when you use the Services, including internet or other network activity information (as described below), unique device identifiers, browsing and search history (including content you have viewed on the Services), and from cookies and other technologies (as described below). Information collected automatically includes:
2.3.1 Log information. We retain information about you when you access and use the Services. This information can include, e.g., the following: Internet Protocol (“IP”) address, timestamps, device ID, browser information, Internet Service Provider, webpages visited, and the URL of the webpage you visited before navigating to our Site.
2.3.2 Usage Information. We monitor user activity in connection with the Services and may collect information about the features you use, pages/links that you visit, as well as the amount of time that you spend on the Services.
2.3.3 Crash and Error Information. If the Services crashes or returns an error, we may collect data to determine the cause of the error using first or third-party services. The crash or error information collected may include, e.g., the following: device IP address, device name, operating system version, application configurations(s), the time and date, and other statistics.
3. Cookies and Other Technologies
Our Site may use cookies and other technologies (such as “pixel tags”, “web beacons”, “clear GIFs”, tracking scripts, links in e-mails, JavaScript, device IDs assigned by Google or Apple, or similar technologies) to collect information and support certain features of our Services. Cookies and other technologies allow us and third-parties to obtain information about your visits to our Services, including analyzing your visiting patterns, as well as your visits to and use of other websites and services. For example, we use Google Analytics to collect information to improve the Services, such as how often users visit a website, what pages they visit when they do so, and what other website they used prior to visiting the Site. Google Analytics places a cookie on your web browser so that it can identify you the next time you visit the Site, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to our website and use of our Site is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. Although you are not required to accept cookies when you visit our Site, you may be unable to use all of the functionality of our Site if your browser restricts our cookies. We use this information to process your requests and to deliver online and mobile advertisements, messages, and content for us that are specific to your interests. The information we collect from cookies and other technologies does not identify you personally but in some cases, we may link it to your Personal Data, including, but not limited to your IP address used to access our Site.
3.1 Cookies. Below, we explain the different types of cookies that may be used on the Site.
3.1.1 Necessary Cookies. Necessary cookies are required to enable the basic features of this Site, such as providing secure log-in or adjusting your consent preferences. These cookies do not store any Personal Data.
3.1.2 Functional Cookies. Functional cookies help perform certain functionalities like sharing the content of the Site on social media platforms, collecting feedback, and other third-party features.
3.1.3 Analytical Cookies. Analytical cookies are used to understand how visitors interact with the website. These cookies help provide information on metrics such as the number of visitors, bounce rate, traffic source, etc.
3.1.4 Performance Cookies. Statistics cookies help collect information about your use of the Site and enable us to improve the way it works. These cookies give us aggregated information that we use to monitor the Site’s performance, count page visits, spot technical errors, see how users reach the Site, and measure the effectiveness of marketing (including e-mails).
3.1.5 Advertisement/Marketing/Targeting Cookies. Our Site may use/incorporate third-party marketing cookies to enhance your experience by providing personalized content and advertisements to you based on your browsing activities. These cookies are placed by third-party marketing partners, such as social media platforms, to track your online behavior across websites and services. Third-party marketing cookies may collect the pages that you visit on our Site and other websites, links you click and your interactions with our advertisements, your browsing habits, such as time spent on different pages, and information about your device, including your IP address, browser type, and operating system. The data collected by these cookies are used to deliver targeted marketing campaigns based on your preferences and interests and to measure the performance and effectiveness of such marketing efforts. You have control over the use of third-party advertisement cookies and can opt out or modify your preferences at any time by using our cookie consent banner displayed on our Site, which allows you to reject advertisement cookies or by adjusting your browser settings to block or delete cookies. For the avoidance of doubt, any advertisements related to our products that you may see, which may, in part be due to data collected from third-party advertisement cookies, are not governed by our Privacy Policy and, rather, are governed by the privacy policy of the website which is displaying the advertisement to you.
3.1.6 Unclassified Cookies. Unclassified cookies are cookies that we are in the process of classifying, together with the providers of individual cookies.
3.2 Pixel Tags. Pixels are small pieces of code embedded into our Site that allow us and our third-party partners to track user interactions and website activity. Our Site may utilize certain pixels to help us deliver and measure the effectiveness of our advertising campaigns on social media platforms, such as Facebook, TikTok, and others. We may use pixels to track your interactions with our Site, including the pages you visit and actions you take (e.g., making a purchase, signing up for email newsletters), to measure the performance of our social media ad campaigns by monitoring conversions and engagement, to create custom audiences for our social media ads based on your activity on our website, and to deliver personalized ads and content based on your interactions with our Site and social media platforms. The data collected via pixels may include your IP address and browser type, the pages you visit on our Site and the actions you take, the referrer URL (the link that brought you to our Site), and the time spent on each page and other browsing activity. This data is provided to certain social media platforms to help us create targeted advertising campaigns and better understand user engagement with our Site and advertisements. You have control over the use of pixels and can opt out or modify your preferences at any time by using our cookie consent banner displayed on our Site, which allows you to reject pixels by rejecting advertisement cookies.
4. How We Use Your Information
(a) We may use the Personal Data that we collect for our legitimate interests and the limited purpose of providing the Services and as permitted by applicable law. These purposes include circumstances where it is necessary to provide or fulfill the services requested by or for you or where you have given us your express consent. We may use your Personal Data to:
- Provide the information, products, and services you request;
- Provide you with effective customer service;
- Better understand your needs and interests, and provide you with a personalized experience when you use our Services;
- Contact you, or provide you, with special offers, advertisements, and other information we believe will be of interest to you (in accordance with any privacy preferences you have expressed to us);
- Contact you with information that you have requested and notices related to your use of our Services;
- Invite you to participate in surveys and provide feedback to us (in accordance with any privacy preferences you have expressed to us);
- Improve our products and services, develop new products and services, improve our marketing and promotional efforts, and improve the content, functionality, and usability of the Services;
- Enforce our other policies, such as our Terms of Use;
- Promote security and protect against and prevent fraud, claims, and other liabilities;
- Verify the information you provide to us as well as the representations and warranties you make to us in our policies or on the Site;
- Meet our internal and external audit obligations; and
- Use for any other purpose for which we provide notice at the time of collection.
(b) We may aggregate and/or de-identify information collected through the Services and from other sources so that such information can no longer be linked to you or your device (“Aggregate/De-Identified Information”). We may use Aggregate/De-Identified Information for any purpose, including, without limitation, for research and marketing purposes.
(c) Earflo is a medical device intended for consumer use and is not intended to replace professional medical advice. You should consult a qualified healthcare professional regarding any medical condition. Use of our Services does not create a healthcare provider–patient relationship, and we do not act as a covered entity under applicable health privacy laws such as HIPAA.
5. How We Share and Disclose Information
5.1 Service Providers. We provide access to or share your Personal Data with select third parties who perform services on our behalf. They have access to perform these services but are prohibited from using your Personal Data for other purposes. They provide a variety of services to us, including, for example, billing, sales, marketing, product content and features, advertising, analytics, research, customer service, data storage, security, fraud prevention, payment processing, and legal services.
5.2 Business Partners. Sometimes we collaborate with other organizations and we may share your Personal Data to jointly offer products and services.
5.3 Advertising Partners. In conjunction with Section 3 above, through our Services, we may allow third party advertising partners to set third-party cookies and pixels to collect information regarding your activities and your device (e.g., your IP address, mobile identifiers, page(s) visited, location, time of day). We may also combine and share such information and other information (such as demographic information and past purchase history) with third party advertising partners. These advertising partners may use this information (and similar information collected from other websites) for purposes of delivering targeted advertisements to you when you visit third party websites within their networks. If you prefer not to share your Personal Data with third party advertising partners, you can opt out or modify your cookie and/or pixel preferences at any time by using our cookie consent banner displayed on our Services, which allows you to, for example, reject or manage advertisement cookies (which includes pixels).
5.4 Your Consent. We may ask for your consent to share your Personal Data with third parties. When we do, we will make clear why we want to share the information. We may share your information for other purposes pursuant to your consent or with your further direction.
5.5 Aggregate/De-Identified Data. From time to time, we may share Aggregate/De-Identified Information about use of the Services, such as by publishing a report on usage trends. The sharing of such data is unrestricted.
5.6 Legal Reasons. We may also disclose your Personal Data when we, in good faith, believe disclosure is appropriate to comply with the law, a court order, or a subpoena. We may also disclose your Personal Data to prevent or investigate a possible crime, such as fraud or identity theft; to protect the security of our Services; to enforce or apply our policies or other agreements; or to protect our own rights or property or the rights, property or safety of our users or others. We will attempt to notify our users about legal demands for their Personal Data when appropriate in our judgment unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, in our discretion, that the requests are overbroad, vague, or lack proper authority.
5.7 Sale, Merger, or Other Business Transfer. As we continue to develop our business, we may buy, merge, or partner with other companies. In such transactions (including in contemplation of such transactions), Personal Data may be among the transferred assets. If a portion or all of our assets are sold or transferred to a third party, your Personal Data would likely be one of the transferred business assets. If such transfer is subject to additional mandatory restrictions under applicable laws, we will comply with such restrictions.
6. Your Choices
(a) You may stop or restrict the placement of cookies on your device or remove them by adjusting your preferences as your browser or device permits or by modifying your cookie and pixel preferences via our cookie consent banner located on our Site’s homepage. The online advertising industry also provides websites from which you may opt out of receiving targeted ads from data and advertising partners that participate in self-regulatory programs. You can access these and learn more about targeted advertising and consumer choice and privacy, at www.networkadvertising.org/managing/opt_out.asp and www.aboutads.info/choices/. To separately make choices for mobile apps on a mobile device, you can download DAA’s AppChoices application from your device’s app store. Alternatively, for some devices you may use your device’s platform controls in your settings to exercise choice. Please note you must separately opt out in each browser and on each device. Advertisements on third party websites that contain the AdChoices link may have been directed to you based on information collected by advertising partners over time and across websites. These advertisements provide a mechanism to opt out of the advertising partners’ use of this information for interest-based advertising purposes.
(b) You have a choice at any time to stop us from sending you emails for marketing purposes by following the “unsubscribe” link included in these messages. Please note that despite any indicated email marketing preferences, we may continue to send you administrative emails regarding Earflo, including, for example, notices of updates to our policies or this Privacy Policy if we choose to provide such notices to you in this manner.
(c) If you do not provide the information that we need to provide the Services, we may not be able to provide the Services or certain functionalities. We will tell you what Personal Data that you must provide in order to use the Services and related functionalities or services.
(d) Some browsers offer a “do not track” (“DNT”) option. Since no common industry or legal standard for DNT has been adopted by industry groups, technology companies, or regulators, we do not respond to DNT signals. We will make reasonable efforts to continue to monitor developments around DNT browser technology and the implementation of a standard.
7. Additional Information for Residents of Certain US States
7.1 Additional Information for California Residents (Effective January 1, 2023).
7.1.1 If you are a resident of the State of California, you may have certain rights afforded to you under the California Consumer Privacy Act or the “CCPA”, as amended by the California Privacy Rights Act.
7.1.2 We collect Personal Information for the business and commercial purposes described in the section above titled “How We Use Your Information”, and we share Personal Information with the categories of third parties described in the section above titled “How We Share and Disclose Information”. We do not ‘sell’ (as such term is defined in the CCPA) the Personal Information we collect (and will not sell it without providing you a right to opt out). Please note that we do use third-party cookies for our advertising purposes as further described in the section above titled “Information We Automatically Collect”.
7.1.3 California law, if applicable to us, provides some California residents with the rights listed below:
- You may have the right to request that we disclose to you the Personal Information we collect, use, or disclose, and information about our data practices.
- You may have the right to request that we delete your Personal Information that we have collected from you.
- You may have the right to request that we correct your inaccurate Personal Information.
- You may have the right to opt out of the sharing of your Personal Information.
- You may have the right to exercise control over our collection and processing of certain sensitive Personal Information.
- You have the right not to receive retaliatory or discriminatory treatment for exercising these rights.
7.1.4 To request access to or deletion of your Personal Information, or to exercise any other privacy rights under California law, please contact us at help@earflocare.com. With respect to specifically opting out of the sharing of your Personal Information obtained from cookies and pixels, you can opt out/reject at any time by using our cookie consent banner displayed on our Site. In order to verify your request, we may require you to provide us with certain information to be used solely for the purpose of verifying your identity.
7.1.5 Under the CCPA, you may exercise these rights yourself or you may designate an authorized agent to make these requests on your behalf. We may request that your authorized agent have written permission from you to make requests on your behalf and may need to verify your authorized agent’s identity.
7.2 Additional Information for Colorado Residents (Effective July 1, 2023).
7.2.1 The Colorado Privacy Act, if applicable to us, provides some Colorado residents with the rights listed below:
- You may have the right to know and see what Personal Data we have collected about you in a portable format.
- You may have the right to request that we correct your inaccurate Personal Data.
- You may have the right to request that we delete the Personal Data we have collected about you.
- You may have the right to opt out of targeted advertising (as defined under Colorado law).
7.2.2 To request access to or deletion of your Personal Data, or to exercise any other privacy rights under Colorado law, please contact us at help@earflocare.com.
7.2.3 Please note that to respond to some rights we may need to verify your request by asking you to verify your identity by providing information about yourself or your account. You may designate another person to serve as your authorized agent and to exercise your opt-out right on your behalf; however, we may request certain information in order to verify your identity and the authorized agent’s authority to act on your behalf.
7.3 Additional Information for Connecticut Residents (Effective July 1, 2023).
7.3.1 The Connecticut Data Privacy Act, if applicable to us, provides some Connecticut residents with the rights listed below:
- You may have the right to know and see what Personal Data we have collected about you in a portable format.
- You may have the right to request that we correct your inaccurate Personal Data.
- You may have the right to request that we delete the Personal Data we have collected about you.
- You may have the right to opt out of targeted advertising (as defined under Connecticut law).
7.3.2 To request access to or deletion of your Personal Data, or to exercise any other privacy rights under Connecticut law, please contact us at help@earflocare.com.
7.4 Addition Information for Nevada Residents (Effective October 1, 2019).
7.4.1 If you are a Nevada resident, under Privacy and Security of Personal Information Chapter of the Nevada Revised Statutes Section 603A, we are required to provide you with the following:
- We may collect certain covered information (as defined under Nevada Law) when you use or visit our Site, including, but not limited to first and last name, home or other physical address, e-mail address, and telephone number;
- We may share your covered information to third parties as described in the section above titled “How We Share and Disclose Information”; and
- Third parties may collect covered information about your online activities over time and across different internet websites or online websites when you use our Site.
7.4.2 Under Nevada law, certain Nevada consumers may opt out of the sale of “personally identifiable information” for monetary consideration (as such terms are defined under Nevada law) to a person for that person to license or sell such information to additional persons. We do not engage in such activity; however, if you are a Nevada resident who has provided “personally identifiable information” to us via the Site, you may submit a request to opt out of any potential future sales under Nevada law by contacting us at help@earflocare.com. Please note we will take reasonable steps to verify your identity and the authenticity of the request. Once verified, we will maintain your request in the event our practices change.
7.5 Additional Information for Oregon Residents (Effective July 1, 2024).
7.5.1 If you are an Oregon resident, pursuant to the Oregon Consumer Privacy Act, we must share with you that:
- We collect and process the categories of Personal Data described in the section above titled “Information We Collect and Receive”;
- We process Personal Data for the business and commercial purposes described in the section above titled “How We Use Your Information”; and
- We may share the categories of Personal Data described in the section above titled “Information We Collect and Receive” with the categories of third parties set forth in the section above titled “How We Share and Disclose Information”.
7.5.2 Oregon Law, if applicable to us, provides some Oregon residents with the rights listed below:
- You may have the right to receive confirmation as to whether we are processing or have processed your Personal Data and the categories of Personal Data that we are processing or have processed.
- You may have the right to receive, at our option and in our sole discretion, a list of specific third-parties, other than natural persons, to which the we have disclosed your specific Personal Data to or any Personal Data to, generally.
- You may have the right to receive a copy of all of your Personal Data that we have processed or are processing in a portable formation.
- You may have the right to request that we correct inaccurate Personal Data; however, in deciding whether to comply with such request, we may take into account the nature of the Personal Data and the purpose(s) for processing the Personal Data.
- You may have the right to request that we delete your Personal Data, including your Personal Data which you have provided to us, your Personal Data which we have obtained from another source, and derived data.
- You may have the right to opt out from our processing of your Personal Data for targeted advertising.
7.5.3 To request access to or deletion of your Personal Data, or to exercise any other privacy rights under Oregon law, please contact us at help@earflocare.com. If you would like to appeal our refusal to take action on a prior submitted request, you may do so by submitting an appeal to us at help@earflocare.com.
7.5.4 Please note that to respond to some rights we may need to verify your request by asking you to verify your identity by providing information about yourself. You may designate another person to serve as your authorized agent and to act on your behalf to opt out of the processing of your Personal Data under specifically Section 7.5.2(vi); however, we may request certain information in order to verify your identity and the authorized agent’s authority to act on your behalf.
7.6 Additional information for Texas Residents (Effective July 1, 2024).
7.6.1 If you are a Texas resident, pursuant to the Texas Data and Privacy Security Act, we must share with you that:
- We collect and process the categories of Personal Data described in the section above titled “Information We Collect and Receive”;
- We process Personal Data for the business and commercial purposes described in the section above titled “How We Use Your Information”; and
- We may share the categories of Personal Data described in the section above titled “Information We Collect and Receive” with the categories of third parties set forth in the section above titled “How We Share and Disclose Information”.
7.6.2 Texas law, if applicable to us, provides some Texas residents with the rights listed below:
- You may have the right to receive confirmation as to whether we are processing your Personal Data and the right to access such Personal Data.
- You may have the right to request that we correct inaccuracies with respect to your Personal Data; however, in deciding whether to comply with such request, we may take into account the nature of the Personal Data and the purpose(s) for processing the Personal Data.
- You may have the right to request that we delete your Personal Data which you provided or which we have obtained about you.
- If the such data is available in a digital formation, you may have the right to receive a copy of your Personal Data that you previously provided to us in a portable format and, to the extent technically feasible, in a readily usable format that allows you to transmit the data to another controller without hinderance.
- You may have the right to opt out from our processing of your Personal Data for targeted advertising,
7.6.3 To request access to or deletion of your Personal Data, or to exercise any other privacy rights under Texas law, please contact us at help@earflocare.com. If you would like to appeal our refusal to take action on a prior submitted request, you may do so by submitting an appeal to us at help@earflocare.com.
7.6.4 Please note that to respond to some rights we may need to verify your request by asking you verify your identity by providing information about yourself. You may designate another person to serve as your authorized agent and to act on your behalf to opt out of the processing of your Personal Data under specifically Section 7.6.2(v)(a)-(b); however, we may request certain information in order to verify your identity and the authorized agent’s authority to act on your behalf.
7.7 Additional Information for Utah Residents (Effective December 31, 2023).
7.7.1 If you are a Utah resident, pursuant to the Utah Consumer Privacy Act, we must share with you that:
- We collect Personal Data for the business and commercial purposes described in the section above titled “How We Use Your Information”;
- We may share your Personal Data to third parties as described in the section above titled “How We Share and Disclose Information”; and
- We collect the categories of Personal Data described in the section above titled “Information We Collect and Receive”.
7.7.2 Utah law, if applicable to us, provides some Utah residents with the rights listed below:
- You may have the right to know and see what Personal Data we have collected about you in a portable format.
- You may have the right to request that we delete the Personal Data we have collected about you.
- You may have the right to opt out of targeted advertising (as defined under Utah law).
7.7.3 To request access to or deletion of your Personal Data, or to exercise any other privacy rights under Utah law, please contact us at help@earflocare.com.
7.8 Additional Information for Virginia Residents (Effective January 1, 2023).
7.8.1 If you are a Virginia resident, pursuant to the Virginia Consumer Privacy Act, we must share with you that:
- We collect Personal Data for the business and commercial purposes described in the section above titled “How We Use Your Information”;
- We may share your Personal Data to third parties as described in the section above titled “How We Share and Disclose Information”; and
- We collect the categories of Personal Data described in the section above titled “Information We Collect and Receive”.
7.8.2 Virginia law, if applicable to us, provides some Virginia residents with the rights listed below:
- You may have the right to know and see what Personal Data we have collected about you.
- You may have the right to request that we correct your inaccurate Personal Data.
- You may have the right to request that we delete the Personal Data we have collected about you.
- You may have the right to opt out of targeted advertising (as defined under Virginia law).

8. Data Retention and Deletion
We retain personal information only for as long as necessary to provide our Services, and fulfil the purposes described in this Privacy Policy. This may include retaining data to:
- provide and improve our products and services;
- maintain user accounts and app functionality; and
- comply with legal, regulatory, or reporting obligations.
